Thousands of workers ask this question before taking a Gulf job – Will My Passport Be Seized by My Gulf Employer? It is a fair concern. The Gulf region attracts workers with high pay and strong opportunities. However, it also carries a documented history of labour abuse. Passport confiscation sits at the top of that list.
So, can your passport be seized by a Gulf employer? The short answer is no. Every GCC country bans it by law.
What Gulf law says about passport confiscation
No Gulf employer has the legal right to take your passport. The UAE’s Federal Law No. 10 of 2017 guarantees every foreign worker the right to hold their own documents. Saudi Arabia introduced similar laws in October 2023, explicitly banning passport confiscation. Qatar and Kuwait have matching provisions.
Moreover, recent reforms have strengthened worker protections significantly. The UAE’s 2021 Labour Law reforms allow workers to change employers without the current employer’s consent. Workers facing illegal treatment can now terminate contracts and seek new employment. Saudi Arabia announced the abolishment of the Kafala system in June 2025, under its Vision 2030 programme.
Therefore, the law clearly protects you. Additionally, authorities like the UAE Ministry of Human Resources (MOHRE) actively enforce these rules through inspection campaigns and a formal complaints platform.
When a Gulf employer can hold your passport temporarily
There are three situations where your employer can hold your passport for a short, defined period:
- While applying for your new work visa
- During visa renewal
- When cancelling your visa on departure
In each case, your employer must return the passport after visa stamping. Any arrangement beyond these three situations requires your written, signed consent. This means both parties agree in writing, and you retain a copy.
Furthermore, employers sometimes hold passports to avoid legal liability. If a worker commits a crime and flees, the employer faces prosecution. However, this arrangement must still be mutual and documented.
The reality on the ground
The law is strong. Enforcement, however, varies by country and sector. Reports from Qatar indicate that the vast majority of migrant workers’ passports remained with their employers, despite clear laws against it. In Kuwait, authorities received over 1,400 passport confiscation complaints in a single reporting year. In Bahrain, labour authorities recovered and returned 812 passports to workers in one period alone.
Consequently, domestic workers face the highest risk. Saudi Arabia’s 2023 reforms excluded domestic staff, drivers, and security guards from full labour law protection. These workers remain the most vulnerable group across the GCC.
Still, professional and skilled workers in verified companies face considerably lower risk. The UAE in particular has improved enforcement meaningfully since 2021.
What to do if your passport gets seized by a Gulf employer
If your passport gets seized by a Gulf employer, act quickly. Do not wait.
First, request your passport back in writing. A written request creates a paper trail. It often resolves the issue without further escalation. Second, contact the relevant labour ministry. In the UAE, file a complaint with MOHRE through their official platform. Third, reach out to your home country’s embassy. Consular services exist specifically for citizens facing document retention. Finally, seek qualified legal advice from a UAE or GCC-licensed labour lawyer.
You have clear legal rights. Do not allow fear or uncertainty to stop you from using them.
